Woman alleges third party illegally attempts to collect alleged QVC debt

EAST ST. LOUIS — A woman alleges a third party debt collector is trying to collect on an alleged QVC debt without providing validation that a debt exists. 

Judiette R. White filed a complaint Oct. 13 in the U.S. District Court for the Southern District of Illinois East St. Louis Division against Resurgent Capital Services LP and LVNV Funding LLC, alleging violation of the Fair Debt Collection Practices Act. 

According to her complaint, White claims QVC Inc. accused her of defaulting on a debt. She received a collection email on March 12 from TrueAccord, a third party debt collector associated with the defendants. 

"Upon receiving the March 12 email, plaintiff became confused and distressed, as anything she had every purchased through QVC was previously paid in full and so she did not believe she owed the subject debt upon which TrueAccord was seeking collection," the suit states. 

White claims she sent a written dispute regarding the debt on April 5, requesting validation of the purported QVC debt. She claims the third party collector failed to provide sufficient validation of the debt. 

White further claims the supposed debt was "unfairly and deceptively" placed with a new third party debt collector and that the defendants have violated her rights under the Fair Debt Collection Practices Act. She alleges the defendants "deceptively suggested" her account summary sufficiently validated the debt and has failed to provide further proof of the debt yet continues its collection efforts. 

White claims she has suffered mental distress and other damages as a result of the defendants' actions. 

White seeks monetary relief, trial by jury and all other just relief. She is represented by Nathan Volheim of The Sulaiman Law Group LTD in Lombard.
