Pedestrian sues Madison over trip, fall on manhole cover

EDWARDSVILLE — A woman claims she fell over a depressed manhole cover in Madison and incurred more than $100,000 in medical treatment costs.

Vickie Blakely-Gissendanner filed a complaint Oct. 6 in the Madison County Circuit Court against City of Madison, alleging negligence. 

According to her complaint, the plaintiff was walking along a sidewalk on 5th Street and Madison Avenue in the City of Madison on Oct. 20, 2020. She alleges she tripped and fell on a "depressed area of the sidewalk" caused by an electrical manhole set below the sidewalk surface. 

The plaintiff alleges Madison failed to provide warning of the depressed manhole cover, improperly installed the cover and failed to have a safe area for pedestrians who are using the sidewalk. She also alleges Madison did not reasonably inspect the manhole cover, which would have shown the danger and risk to pedestrians. 

The plaintiff claims that as a result of her fall, she incurred $101,877.03 in medical bills. 

The plaintiff seeks compensation of more than $50,000, trial by jury and all other just relief. She is represented by Douglas Salsbury of The Miller Salsbury Law Firm in Eureka, Mo.
