Tenant sues over icy slip, fall at Edwardsville apartment complex

EDWARDSVILLE — A tenant at an Edwardsville apartment claims she slipped and fell on black ice that accumulated at the bottom of the stairs at her apartment complex, causing her to suffer injuries. 

Natalie Nava filed a complaint Sept. 28 in the Madison County Circuit Court against Woodcrest Apartments LLC, HP Management Inc., and Nick Smith, alleging negligence and premises liability. 

Nava alleges in her complaint that she left her apartment located on West Union Street in Edwardsville when she slipped and fell on black ice as she was coming down the stairs to get to her car. She alleges that as a result of the fall, she suffered a fractured tibia and fibula. 

Nava claims that prior to her slip and fall in January 2021, the defendants installed a guttering/storm water drainage system with downspouts that discharged around the bottom of the stairs and onto the blacktop parking lot. The location of the downspouts allegedly allowed ice to form and blend into the concrete. 

Nava claims the defendants failed to properly maintain or inspect the stairway and failed to properly direct the water and melted snow on the premises. 

Nava seeks monetary relief of more than $50,000, interest and all other proper relief. She is represented by Ryan Sweet of Swanson, Sackett & Sweet PC in Edwardsville and Jeff Ezra of Ezra & Associates in Edwardsville.
