EDWARDSVILLE — A truck service company alleges a surgeon fraudulently billed for procedures he didn't perform on the plaintiff's employee following a work injury.
Jung Truck Services Inc., filed a complaint Sep. 27 in the Madison County Circuit Court against Midwest Bone & Joint Surgery PC and Dr. Felix F. Ungacta, alleging fraudulent misrepresentation, fraudulent concealment and other claims.
According to Jung Truck's complaint, its employee Jeffrey Seymore suffered an injury on the job on April 6, 2018, and filed workers' compensation. It alleges Ungacta performed arthroscopic surgery on Seymore's shoulder to repair a rotator cuff tear on May 2, 2018. Seymore allegedly underwent another shoulder surgery in June 2018. However, Jung Truck claims Ungacta failed to perform a rotator cuff repair as listed in the surgery bill. Then in September 2018, the plaintiff alleges Ungacta also failed to perform specific repairs to Seymore's shoulder but listed the procedures in the bills submitted, which Seymore was contractually obligated to pay. The plaintiff alleges the defendants made false statements to obtain payment for procedures which were not performed or medically necessary.
The plaintiff seeks a judgment in excess of $50,000, plus costs. It is represented by James Kelly and Jason Jording of Peoria, Ill.
