EDWARDSVILLE — A Glen Carbon-based company alleges one of its employees diverted the sale of products to the plaintiff's customers using his own company.
FASTechnology Group LLC filed a complaint Sept. 20 in the Madison County Circuit Court against Dion Volk and Goliath Group Inc., alleging breach of contract, unjust enrichment and other claims.
According to FASTech's complaint, it entered into an employment contract with Volk on May 17, 2016, for him to serve as the company's Consumer Packaged Goods Packaging Systems Business Unit director. The plaintiff alleges that without its authorization, Volk diverted sales of packaging machines and factory and industrial automation systems away from FASTech and sold them to the company's established customers using his own company Goliath Group.
FASTech further alleges that through at least 2019, Volk covered up his "deceit" by falsely representing to FASTech customers that Goliath was a subsidiary of FASTech all while remaining an employee of FASTech.
The plaintiff also claims Goliath Group had been placed in delinquent status by the State of Wisconsin in July 2017, and that Volk restored his LLC to "good standing" just months after signing his employment agreement with FASTech.
FASTech seeks compensation of more than $50,000 and all other proper relief. It is represented by James Nowogrocki of Summers Compton Wells LLC.
