Father claims rear end collision in construction zone resulted in son's death

EDWARDSVILLE — A father is suing a home construction company after one of its employees caused a fatal rear end collision in a construction zone, resulting in the death of his son. 

Christian Mueller, as special administrator of the Estate of Grayson Mueller, a minor, deceased, filed a complaint Sept. 13 in the Madison County Circuit Court against William Ball and Legacy Homes and Construction LLC, alleging wrongful death. 

According to Mueller's complaint, he was driving his Ford Focus on I-270 in Pontoon Beach on Aug. 27. He alleges that Ball, who in the scope of his employment with Legacy Homes, was driving a Ford F-350. Mueller claims he slowed down to merge with traffic in a construction zone when Ball collided into the rear of his vehicle at a high rate of speed, which caused his son Grayson to die on impact. 

Mueller alleges Ball was negligent for failing to keep a proper lookout, failing to keep his vehicle under control and for speeding. Mueller further alleges Ball failed to slow down, stop or swerve in order to avoid the collision. 

Mueller seeks compensation of more than $50,000 and all other just relief. He is represented by John Hipskind and Brady McAninch of Hipskind & McAninch in Belleville.
