Class action alleges Jimmy Dean muffin sandwiches falsely labeled as 'whole grain'

EAST ST. LOUIS — Hillshire Brands is facing a class action alleging its Jimmy Dean Delights English muffin sandwich is falsely labeled as "whole grain." 

Erin Sanders, individually and on behalf of all others similarly situated, filed a complaint Sept. 18 in the U.S District Court for the Southern District of Illinois East St. Louis Division against The Hillshire Brands Company, alleging violation of the Illinois Consumer Fraud and Deceptive Business Practices Act, breach of express warranty, negligent misrepresentation and other claims. 

Sanders alleges in her complaint that the defendant's fraudulently label and misrepresent the ingredients in their Jimmy Dean Delights English Muffin "whole grain" turkey sausage, egg white & cheese sandwich. She claims the primary ingredient in the product is enriched wheat flour and that the product does not contain the required minimum amount of whole grains under USDA rules to claim its product is "whole grain." Specifically, Sanders claims the product contains only five grams of whole grain instead of the required 8 grams per serving size. Sanders further claims she and other consumers paid a higher price for the product which was "materially less than its value as represented."

Sanders seek monetary relief, trial by jury and all other proper relief. She is represented by Spencer Sheehan of Sheehan & Associates PC in Great Neck, N.Y.
