EAST ST. LOUIS — A man claims Walgreens violated the Fair Credit Reporting Act (FRCA) by denying him a job based on his Consumer Report without providing him with a copy of the report or a summary of his FRCA rights.
Randall Gardner individually and on behalf of all others filed a complaint Sept. 13 in the U.S. District Court for the Southern District of Illinois against Walgreen Co., alleging violation of the FCRA.
Gardner applied for employment with Walgreens in June, according to the class action suit. He alleges he was offered a customer service associate position with a tentative start date of July 1. Gardner claims that prior to his work start date, he was told that he did not pass one part of the background check and could not be hired. He alleges that information contained in his Consumer Report prevented him from getting the job and that he was never provided a copy of his report, provided a copy of the FCRA summary of rights or a reasonable amount of time to challenge the information in his report. Gardner also claims that Walgreens was in violation of the FCRA and that receiving a copy of his report would have helped him understand his denial for employment.
Gardner seeks monetary relief, trial by jury and all other just relief. He is represented by Jayson Watkins and C. Jason Brown of Brown & Watkins in Gower, Mo.
