BELLEVILLE — A father is suing a motorist after his two month old son died in a rear end collision in a construction zone on I-270 in Pontoon Beach.
Christian Mueller, as special administrator of the Estate of Grayson Mueller, a minor, deceased, filed a complaint Sept. 13 in the St. Clair County Circuit Court against William Ball and Legacy Homes and Construction LLC, alleging wrongful death.
According to the complaint, Mueller was driving his Ford Focus on I-270 in Pontoon Beach on Aug. 27 and was slowing down to merge with traffic in a construction zone. He alleges that his two month old son, Grayson Mueller, died on impact when Ball collided with the rear of Mueller's vehicle at a high rate of speed.
Mueller claims Ball, who was within the scope of his employment with Legacy Homes and Construction, failed to keep a proper lookout, was speeding and failed to operate his vehicle in a safe and proper manner. He also claims Ball failed to decrease his speed, stop or swerve in order to try to avoid the collision.
Mueller seeks compensation of more than $50,000 and all other just relief. He is represented by John Hipskind and Brady McAninch of Hipskind & McAninch LLC in Belleville.
