Suit alleges contractor failed to fix leaks in roof waterproofing

EDWARDSVILLE — Cohen Foods alleges the contractor it hired to install waterproofing on its warehouse roofs refuses to fix multiple leak issues. 

Cohen Foods Inc., filed a complaint Sept. 7 in the Madison County Circuit Court against R&A Contracting Inc., alleging breach of express warranty and breach of implied warranty, fraud and other claims. 

Cohen Foods alleges in its complaint that in September 2016, they hired R&A Contracting to install a waterproof roofing system at its warehouse spaces in Granite City for a cost of $129,559. The plaintiff alleges that in May 2017, Cohen employees began to notice leaks in the roof of the buildings. Then in July 2017,the plaintiffs allegedly noticed cracks in the polyurethane coating of the buildings. Cohen claims that despite their multiple requests and R&A's confirmation that necessary repairs were needed and would be made, R&A has not repaired the leaks. Among Cohen's claims is that R&A made fraudulent statements about its intention to make the repairs or abide by its warranty. 

Cohen seeks compensation of more than $50,000, trial by jury and all other proper relief. They are represented by Emily Cartwell of Lathrop GPM LLP in Clayton, Mo.
