Driver sues insurer over failure to deny, arbitrate underinsured motorist claim

EDWARDSVILLE — A woman alleges the Standard Fire Insurance Company failed to deny or arbitrate her underinsured motorist policy claim. 

Connie S. Ochoa filed a complaint  Aug. 31 in the Madison County Circuit Court against The Standard Fire Insurance Company, alleging vexatious conduct. 

According to the complaint, Ochoa was driving her daughter's Dodge Ram on Nov. 10, 2019, and traveling in the outside lane of Landmarks Boulevard in Alton. She alleges another driver failed to yield the right of way while turning onto US 67 and struck the Dodge Ram. Ochoa claims that at the time, her daughter held a policy from the defendant. 

Ochoa alleges she was paid from the at fault driver's $25,000/$50,000 liability policy and that she submitted a "demand" to the defendant on June 8, for the balance of the underinsured limits of $75,000 or for arbitration. She claims the defendant failed to deny the claim, extend arbitration or give a "good faith explanation for their failure to act." 

Ochoa seeks compensation of more than $50,000 and all other just relief. She is represented by Keith Short of Keith Short and Associates PC in Alton.
