Home sellers allegedly failed to disclose property defects

EDWARDSVILLE — A home buyer claims the sellers knew of property defects but failed to report the issues and made inferior repairs in an attempt to conceal them. 

Brandy Menley filed a complaint Aug. 31 in the Madison County Circuit Court against Krista Forrester and John Kevin Forrester.

According to the complaint, Menley purchased a residential property from the Forresters and took possession of the property on Aug. 31. She alleges the Forresters failed to disclose numerous defects with the property. Specifically, Menley claims the property has defects with the foundation, walls, doors, floors, HVAC system and electrical system. Menley alleges the Forresters failed to advise her of the defects on their residential real property disclosure report and made "inferior" improvements to the property to try and cover up the defects. She further alleges that other issues with the property continue to be discovered as professionals "determine the extent of the defects." 

Menley seeks compensation of more than $50,000 and all other proper relief. She is represented by Thomas DeVore of The Silver Lake Group LTD in Greenville.
