Motorist allegedly hits accelerator instead of brake, causes rear end collision

EAST ST. LOUIS — A motorist alleges another driver hit the accelerator instead of the brakes, causing a rear end collision in the World Wide Technology Raceway parking lot.  

Tony D. Kelly filed a complaint Sept. 1 in U.S. District Court for the Southern District of Illinois against Alan Schakel, alleging negligence. 

According to Kelly's complaint, he was a passenger in a vehicle that was driving on the parking grounds of World Wide Technology Raceway in Madison County on Sept. 29, 2019. He alleges that as the car he was riding in was slowing in order to get in line for a parking space, Schakel's vehicle rear ended the vehicle multiple times and caused him to suffer injuries to his head, back, neck, elbow, legs and internal organs. 

Kelly claims Schakel was negligent for carelessly pressing the accelerator instead of the brake after the first impact, which then caused a second impact. He further claims Schakel was speeding, failed to pay attention and operated his vehicle in an unsafe manner on the parking grounds.

Kelly seeks compensation of more than $75,000, trial by jury and all other proper relief. He is represented by Daniel Katzman of Katzman & Sugden LLC in Belleville.
