Shopper sues over icy slip, fall at O'Fallon Walmart

BELLEVILLE — A shopper claims she suffered injuries when she slipped on ice accumulation in a Walmart parking lot in O'Fallon. 

Kiara Gomiller filed a complaint Aug. 25 in the St. Clair County Circuit Court against Washington Prime Group Inc., and KLM Commerical Sweeping Inc., alleging negligence. 

On Dec. 17, 2019, Gomiller was walking in the parking lot owned by Washington Prime Group and maintained by KLM that provided parking to Crown Vision Center and Walmart located on West U.S. 50 in O'Fallon, according to her complaint. Gomiller alleges she slipped and fell on an unnatural ice accumulation that was in the parking lot and suffered an ankle fracture and other injuries. 

Gomiller claims the defendants were negligent for allowing the ice to accumulate in the parking lot and failing to barricade the area until the ice and snow had been removed. She further claims that if the defendants had used "ordinary care," then they could have known of the hazard in the area where automobiles park. 

Gomiller alleges that as a result of her slip and fall, she also suffered pain, mental anguish and required medical care and treatment. 

Gomiller seeks monetary relief of more than $50,000 and all other proper relief. She is represented by John Hipskind and Brady McAninch of Hipskind & McAninch in Belleville.
