EAST ST. LOUIS — A contracting company is being sued for allegedly failing to pay contributions and submit reports per a collective bargaining agreement with the plasters and cement mason local union.
Employers & Cement Masons #90 Health & Welfare Fund, by and through its board of trustees, and Employers and Cement Masons #90 Pension Fund, by and through its board of trustees, filed a complaint Aug. 18 in the U.S. District Court for the Southern District of East St. Louis Division against Groundworks Contracting Inc., alleging delinquent fringe benefit contributions.
According to the plaintiffs' complaint, Groundworks is "signatory" to one or more collective bargaining agreements with the Local #90, Operative Plasters and Cement Masons International Association, AFL-CIO.
The plaintiffs allege the collective bargaining agreements require Groundworks to submit monthly reports on hours and wages paid to employees and to pay monetary contributions to the plaintiffs' funds. The plaintiffs claim Groundworks has employed members of the bargaining unit represented by Local #90 but has failed to submit the reports or make their payment contributions estimated to be $3,848.70. They further claim Groundworks has refused to submit the reports or contributions "despite its contractual obligation."
The plaintiffs seek monetary and all other proper relief. They are represented by James Kimmey of Cavanagh & O'Hara LLP in Edwardsville.
