EDWARDSVILLE — Progressive Insurance is suing the driver accused of causing a collision in Granite City, resulting in an insurance claim of more than $51,000.
Progressive Insurance Company filed a complaint Aug. 26 in the Madison County Circuit Court against James Moser.
According to Progressive's complaint, its insured Nicole Counsell was operating her vehicle with a passenger in Granite City on Sept. 7, 2019. The plaintiff alleges Moser "violently collided" with Counsell's vehicle and caused "med pay and bodily injury damages" to her and her passenger.
Progressive claims Moser was operating his vehicle too fast for the conditions, was driving in a reckless and unlawful manner, failed to keep a proper lookout and did not try to stop or divert his vehicle's course to avoid the collision.
Progressive alleges that as a result of Counsell's and her passenger's injuries, the plaintiff has paid $51,150.75 for her claim.
Progressive seeks compensation of $51,150.75, interest and all other proper relief. They are represented by Marc Gnade of The Law Office of Marc Gnade in Fenton, Mo.
