Suit alleges falls contributed to nursing home patient's death

EDWARDSVILLE — A lawsuit alleges a resident at an Edwardsville nursing home died after falling several times and suffering injuries. 

David Cruz, individually and as special administrator of the Estate of Enelida Cruz, deceased, filed a complaint July 30 in the Madison County Circuit Court against Edwardsville Care Center LLC, alleging wrongful death and other claims. 

David Cruz alleges in his complaint that Enelida Cruz fell "multiple times" in August 2020 while she was a resident at Edwardsville Care Center nursing home located on St. Mary Drive. He claims her falls resulted in Enelida Cruz suffering injuries, which ultimately led to her death.

The plaintiff claims the defendants failed to provide the decedent with appropriate nursing and medical care. Specifically the plaintiff claims the defendants failed to properly assess and monitor its staff, provided inadequate training for its staff and failed to keep Cruz in a hazardous-free environment. The plaintiff further claims the defendants were negligent in failing to implement safety precautions to protect Cruz, who was a known fall risk, from falling and failed to give Cruz timely medical attention. He claims the defendants should have transferred Cruz to another facility when her needs could no longer be met. 

Cruz seeks compensation of more than $50,000 and all other proper relief. He is represented by Brady McAninch and John Hipskind of Hipskind  McAninch LLC in Belleville.
