Woman sues over icy slip, fall at Maryville dialysis facility

EDWARDSVILLE — A woman is suing a Maryville dialysis center after she allegedly slipped and fell on accumulated ice and snow.  

Donald Wells filed a complaint July 30 in the Madison County Circuit Court against Total Renal Care Inc., also known as Maryville Dialysis, alleging negligence. 

According to her complaint, Wells was at the DaVita Maryville Home Dialysis facility on Vadalabene Drive in Maryville on Jan. 30. The facility is owned by the defendants. She claims that while walking towards the entrance of the facility, she fell on an "unnatural accumulation" of ice and suffered severe and permanent injuries. As a result, Wells claims she has been hindered from her usual duties and affairs and incurred medical expenses. 

Wells alleges the defendants were negligent for failing to inspect and maintain the sidewalk and allowing the sidewalk to become accumulated with ice and snow. She also alleges they negligently allowed a portion of the sidewalk to become "depressed or uneven" and failed to warn of the hazard. Wells claims the defendants negligently failed to provide a safe means of entering and exiting their premises. 

Wells seeks compensation of more than $50,000 and all other just relief. She is represented by John Hipskind and Brady McAninch of Hipskind & McAninch LLC in Belleville.
