EDWARDSVILLE — A Madison County transportation company claims the trucking company it entered into a commercial motor vehicle leasing agreement with has failed to report accurate load amounts and pay the plaintiff accordingly.
Wideman Transportation Inc. filed a complaint Aug. 2 in the Madison County Circuit Court against Rudy Foiles and Foiles Trucking LLC.
Wideman, the lessor, entered into a lease agreement with the defendants on Oct. 16, 2018, according to the complaint. The plaintiff alleges the lease provides for plaintiff, to "from time to time provide" a truck and driver "to handle and transport a 'load' obtained by the defendants," who contracted with a third party. Wideman further alleges the contract called for their compensation of those services to be paid by the defendants "for equipment and driver's services" at "90 percent of the 'load amount.'" Wideman claims the contract states "the lessee will keep 10 percent of the 'load amount' for equipment and driver's services."
The plaintiff claims it was told by the defendant's staff "what they represented to be the load amounts," but were never given documentation to confirm the load amounts. Specifically, Wideman alleges the defendant represented two load deliveries made between June 7 and June 9, had $650 in load amounts when they were actually loads of $700 and $800. Wideman claims it has not been properly paid for those loads.
Wideman seeks monetary and all other just relief. The plaintiff is represented by John Gibbons in Edwardsville.
