Motorist alleges Walmart Transportation driver caused collision at truck stop

EDWARDSVILLE — A transportation and logistic company is seeking reimbursement for worker's compensation claims it paid out to two employees injured in a collision caused by a Walmart Transportation driver at a Pilot Truck Stop in Troy. 

Schneider National Carriers Inc., as subrogee of Ariel Walker and Mayte Cruz Rodriguez, filed a complaint July 8 in the Madison County Circuit Court against Robert Stogsdill and Walmart Transportation LLC, alleging negligence and vicarious liability.

According to the complaint, Walker and Rodriguez were occupying a commercial vehicle near the Pilot Truck Stop on Edwardsville Road in Troy on July 21, 2019. They claim Stogsdill, who was employed by Walmart Transportation and driving a commercial vehicle in the Pilot parking lot, collided with the vehicle occupied by Walker and Rodriguez. 

Schneider National claims that it paid $52,826.98 in worker's compensation benefits to Walker and $11,267.02 to Rodriguez and that the insurer has a "right of subrogation" against any third parties liable for its loss. It also claims Stogsdill negligently operated the vehicle at an unsafe speed and negligently changed lanes, which caused the collision.

Schneider National seeks monetary relief of more than $64,094, interest and all other just relief. It is represented by Stephen Smith of Matthiesen, Wickert & Lehrer SC in Hartford, Wis.
