EAST ST. LOUIS — A St. Clair County man who is blind and uses an auditory reading software for internet use has filed another lawsuit in federal court alleging ADA violations.
Eric Foreman filed a complaint June 25 in the U.S. District Court for the Southern District of Illinois against Ford's Foods Inc., alleging violation of the Americans with Disabilities Act.
Foreman has filed numerous similar lawsuits in district court. According to his new complaint, Foreman is blind after suffering from congenial glaucoma as a child and requires the use of a screen reader voiceover technology to navigate the internet, Windows, cell phone and other devices. He alleges the defendant's website is incompatible with screen reader programs. He alleges the website deprives blind and visually impaired individuals from the defendant's online goods, content and services because it is not fully accessible. Foreman specifically claims the defendant's website does not work for the required input fields while using a screen reader and that error messages are not announced when displayed among other "barriers." He further claims the website's lack of compatibility with auxiliary aids discriminates against those with disabilities and in violation of the ADA.
Foreman seeks monetary and all other just relief. He is represented by Jonathan Miller of Nye, Stirling, Hale & Miller LLP in Santa Barbara, Calif.
