EDWARDSVILLE — A motorist claims State Farm refuses to evaluate and pay his uninsured motorist claim despite having a fully effective policy at the time of the collision.
Frank Anderson, Sr., filed a complaint June 22 in the Madison County Circuit Court against State Farm Mutual Automobile Insurance Company, alleging breach of contract.
Anderson alleges in his suit that he suffered injuries in a collision on Aug. 10, 2018. He claims State Farm has "breached its duty of good faith and fair dealing" by failing to pay his uninsured motorist claim following the crash. Anderson further claims his State Farm policy was in full force at the time of the collision and that he had fully paid all his premiums according to the contract of insurance.
Anderson alleges State Farm's refusal to pay his claim has resulted in loss of contractual policy proceeds as well as emotional distress. He also alleges that State Farm's "attitude toward" his claim has been "cavalier and biased." Anderson claims State Farm has not done a "reasonable evaluation" of his uninsured motorist claim and failed to timely arbitrate his claim.
Anderson seeks compensation of more than $50,000 and all other proper relief. He is represented by Rodney Caffey of The Caffey Law Firm LLC in Godfrey.
