Intoxicated woman allegedly forced out of car gets struck by passing vehicle

EDWARDSVILLE — A woman claims a man forced her to get out of his vehicle while she was intoxicated, causing her to be struck by another vehicle while walking along the dark roadway. 

Tina Moore filed a complaint June 18 in the Madison County Circuit Court against Patricia Kraus and Ryan Perrey, alleging negligence. 

According to the complaint, Moore was a passenger in a vehicle driven by Perrey on Oct. 19, 2019, that was traveling on Illinois Route 3 near the intersection of North Gate Industrial Drive. Moore claims Perrey "wrongfully ejected" her and caused her to exit the car. Moore alleges that as she was walking along the shoulder of Illinois Route 3 after exiting the car, she was struck by Kruas, who was driving his vehicle along the road. 

Moore claims she suffered injuries to her head, brain, back and other parts of her body. 

She alleges Perrey was negligent for forcing her out of the vehicle knowing that she had consumed alcohol. Moore claims the road was dark and poorly lit and had a high volume of traffic. 

Moore also alleges Kraus was negligent for failing to keep a proper lookout on the roadway, traveling at an excessive speed and failing to swerve or slow down in order to avoid striking her with the vehicle. 

Moore seeks compensation of more than $50,000 and all other just relief. She is represented by Joshua Margolis of Muchnick Haber Margolis LC in St. Louis.
