Bricklayers union claims flooring company failed to pay pension contributions

BENTON — A multi-employer bricklayers employee benefit plan and several of its members have filed a claim against Mr. David's Flooring International, alleging the company failed to pay pension fund contributions in violation of the Union's collective bargaining agreement. 

Bricklayers Local #8 of Illinois and Employers Pension Plan, Matt Braun, James Blaney and others filed a complaint June 9 in the U.S. District Court for the Southern District of Illinois against Mr. David's Flooring International LLC, doing business as Mr. David's Carpet Service, alleging violation of the Employee Retirement Income Security Act of 1974 (ERISA). 

According to the plaintiffs' complaint, the defendant employed members of the Union for masonry, brick construction and repair and is bound by a collective bargaining agreement with the Union. The plaintiffs allege they conducted an audit of the defendant's records for Jan. 1, 2017, to Sept. 30, 2020. The audit allegedly shows that Mr. David's owes $5,610.44, including $4,801.71 in pension fund contributions and $808.73 in union dues. The plaintiffs claim the defendant has failed to "submit fringe benefit reports" as well as the required contributions. 

The plaintiffs seek monetary relief, interest and all other just relief. They are represented by Greg Campbell of Hammond and Shinners PC in St. Louis.
