Wrongful death suit alleges long-term care facility provided negligent care

Lawsuits

BELLEVILLE — A Cahokia long term care facility is facing a claim that neglect led to a resident's death from MRSA and sepsis.

Edward Lauko and Mary Germaine, as independent executor of the Estate of Edward Lauko, deceased, filed a complaint April 30 in the St. Clair County Circuit Court against Bria Health Service LLC and Bria of Cahokia, et al., alleging violation of the Illinois Nursing Home Care Act, negligence and wrongful death.

The plaintiffs allege in their complaint that while Edward Lauko was a resident of Bria of Cahokia's long term care facility on Jerome Lane in Cahokia, he suffered injuries due to neglect, malnutrition and pressure ulcers. They claim Lauko was neglected and contracted MRSA Bacteremia and sepsis, which contributed to his death on July 3, 2019. The plaintiffs further allege that Bria "engaged in fraudulent and deceptive practices" by making false representations about the care Lauko would receive while he was a resident of their facility.

The plaintiffs seek compensation of more than $50,000 and all other just relief. They are represented by attorney Grey Chatham, Jr., in Belleville.
