EDWARDSVILLE – A man is suing Home Depot after his hand was allegedly lacerated when he was struck by fence posts that fell out of a rack.

David Price filed a complaint April 23 in the Madison County Circuit Court against Home Depot U.S.A., Inc., alleging negligence.

Price alleges in his complaint that he was shopping at Home Depot on Collinsville Crossing in Collinsville on July 9, 2020, to purchase "metal terminal fence posts." He claims that when he reached for a fence post, several of the posts came "tumbling towards" him, causing  his hand to be lacerated.

Price alleges Home Depot was negligent for failing to place the safety post on the fence display at the correct level to prevent them from falling. Home Depot also negligently failed to install "the usual safety chain" on the fencing display and failed to tape or cap the sharp edges on the fence posts.

Price further claims he suffered injuries to one of his fingers and tendons and has incurred medical treatment costs.

Price seeks compensation of more than $50,000 and all other proper relief. He is represented by Justin Leskera and John Leskera of The Leskera Law Firm in Collinsville.
