Suit alleges tenant sub-leased, stored hazardous materials in breach of lease

EDWARDSVILLE — An Illinois company claims the tenant of one of its California business properties sub-leased and stored hazardous material on the property in breach of the lease agreement. 

Palm Run LLC filed a complaint April 27 in the Madison County Circuit Court against Duden Enterprises Inc., Bryngelson Prints, a sole proprietorship of Harlen Duden, and Harlan Duden, alleging breach of lease agreement. 

Palm Run alleges in its complaint that it entered into a lease agreement with the defendants for building space at a business park located on Crafton Avenue in Redlands, Calif., on April 18, 2019. The plaintiff alleges the defendants have failed to pay rent and have an unpaid balance of $97,269.30. 

Palm Run also alleges the defendants breached the lease agreement by sub-leasing the space for trailer parking and allowed "over the road trailers" to be parked on parts of the property from March 2020 through December 2020, in violation of their lease. The defendants allegedly entered into other sub-leases without the plaintiff's approval. Palm Run claims it is entitled to any proceeds received under the sub-leases. 

In addition, Palm Run claims the defendants stored hazardous material on the leased premises, including waste motor oil and other flammable liquids. 

Palm Run seeks compensation of more than $97,000, interest and all other proper relief. They are represented by attorney Derek Filcoff in Granite City.
