Suit alleges patient's respiratory failure was due to negligent medical care

BELLEVILLE — A suit alleges a Swansea nursing facility and St. Mary's Hospital provided negligent medical care, causing the death of a patient. 

Justin Roberson, as administrator of the Estate of Michael Steward Jr., deceased, filed a complaint April 12 in the St. Clair County Circuit Court against Swansea Rehabilitation & Health Center and SSM Health St. Mary's Hospital, alleging wrongful death. 

Roberson alleges in his complaint that while under the care of the defendants in March and April 2019, Steward suffered a urinary track infection due to the improper use of a catheter. The suit states that the defendants failed to properly monitor and treat the infection. 

The plaintiff claims Steward's death on April 12, 2019, from acute hypoxic respiratory failure was due to the defendants' failure to provide necessary treatment and services including monitoring his airways for obstruction.  Roberson alleges the defendants also failed to minimize physical and mental harm while Steward was under their care. 

Roberson seeks compensation of more than $50,000 and all other just relief. He is represented by Michael Kelly of The Kelly & Bracey Law Offices in Chicago.
