Blind man alleges Science in Sport website does not comply with ADA

EAST ST. LOUIS — A visually disabled man is suing Science In Sport alleging its website is not accessible to him because it is not compliant with the Americans with Disabilities Act (ADA). 

Eric Foreman filed a complaint April 12 in the U.S. District Court for the Southern District of Illinois against Science In Sport Inc., alleging violation of the ADA.

According to his complaint, Foreman is totally blind and uses a screen reader to navigate the Internet and Windows software through voiceover technology. He alleges that the website owned, operated and controlled by Science In Sport is not compatible with computer screen reader programs and has deprived him of access to the website, its content, services and the ability to purchase the defendant's products. 

Specifically, Foreman claims Science In Sport's website fails to "properly label items" and has unaccessible navigation menus. He alleges the defendants have "long known" that "sufficient contrast and skip navigation links" are needed for those visually disabled and that the site remains unaccessible to these individuals in violation of the ADA.  

Foreman seeks monetary and all other just relief. He is represented by Benjamin Sweet of Nye, Stirling, Hale & Miller LLP in Pittsburg and Jonathan Miller of Nye, Stirling, Hale & Miller LLP in Santa Barbara, Calif.
