Dermatologist sued by patient claiming areas of concern were ignored

State Court

BELLEVILLE — A dermatologist is facing a claim he failed to properly diagnose and treat areas on a patient's foot that developed into cancer.

Robert Scaturro and Donna Scaturro filed a complaint April 7 in the Twentieth Judicial Circuit for St. Clair County against Dr. Gary Vicik and Dermassociates LTD alleging negligence.

Robert Scaturro became a patient of Vicik on July 16, 2018, according to the plaintiffs' complaint. They allege that "during the course of his treatment," Robert Scaturro expressed concern to Vicik about areas on his foot that "were growing and spreading" but that Vicik ignored and failed to test the areas.

The plaintiffs claim that after changing physicians on June 9, 2020, Scaturro was diagnosed with cancer. They allege that Vicik was negligent for ignoring "significant symptoms of ill" and failed to order proper testing or to follow up with Robert Scaturro regarding his condition. The plaintiffs claim that due to Vicik's failure to diagnose the cancer, Robert Scaturro's cancer has progressed, he has "become sicker" and that his "life span has been shortened" as they continue to "expend large sums of money" for treatments and cures.

The plaintiffs seek monetary relief of more than $50,000 and all other just relief. They are represented by Ronald Roth of The Roth Law Offices LLC in Granite City.
