EDWARDSVILLE — Ally Bank claims a woman defaulted on a car loan for a Chevrolet Silverado and is suing for surrender of the vehicle.
Ally Bank filed a complaint April 5 in the Madison County Circuit Court against Luxe Holdings Group Inc., William Lindsey, IV and Cyndy Taylor Coca, alleging breach of contract.
According to Ally Bank's complaint, Luxe Holdings entered into a "retail installment sale contract" for a 2019 Chevrolet Silverado with Coca on April 15, 2020, which was then assigned to Ally Bank. It alleges the defendants have "failed to comply with the demand for payment" and have "failed to surrender the vehicle."
Ally Bank alleges in its complaint that it has the right of possession of the vehicle and that Lindsey is wrongfully in possession of the car. The plaintiff claims the fair market value of the vehicle is $34,950. However, according to the sales agreement, Coca allegedly agreed to pay $73,290.58 in addition to finance charges and fees in monthly installments of $1,397.20. She is allegedly in default of the agreement as of Aug. 30, 2020.
Ally Bank seeks monetary and all other just relief. They are represented by Joseph Herbas of LOGS Legal Group LLP in Bannockburn.
