Suit alleges property inspector fell into basement when stairs collapsed

Lawsuits

EDWARDSVILLE — A property inspector claims he suffered multiple injuries when a staircase collapsed, causing him to fall into the basement of a Glen Carbon building.

Thomas Harpstrite filed a complaint April 1 in the Madison County Circuit Court against GMH Inspections, Safeguard Properties LLC and BB&T Bank, alleging negligence.

Harpstrite alleges in his complaint that he was inspecting property in Glen Carbon on Oct. 15, 2020, when he fell into the basement as the basement stairs "suddenly collapsed." He claims that as a result of his fall, he suffered injuries to his leg, hip and back and has incurred medical treatment expenses.

Harpstrite alleges the defendants' agents and employees failed to use "ordinary care" and failed to warn of the danger with a notice, sign or safety cones. He further claims the defendants failed to maintain their property "and keep it safe for visitors and invitees."

Harpstrite seeks compensation of more than $100,000 and all other just relief. He is represented by Andrew Toennies of Kirdendall Dwyer LLP in St. Louis.
