Suit alleges driver caused crash after falling asleep at the wheel

EDWARDSVILLE — A semi-truck driver claims he suffered injuries when another driver fell asleep at the wheel and crashed into the tanker the plaintiff was pulling. 

Shane Richard filed a complaint March 26 in the Madison County Circuit Court against James Courtney Leasing Inc., and Lloyd Courtney, alleging negligence. 

Richard claims in his suit he was driving a Mack semi-truck and pulling a tanker at around four o'clock in the morning on April 16, 2019, on I-55 in Collinsville.  He alleges that Courtney was driving a Ford truck behind him when he fell asleep at the wheel and crashed into the rear of the tanker.

Richard claims that as a result of the collision, he suffered neck, spinal, muscle, ligament and nerve damage that are "painful" and "disabling." 

He alleges the defendants were negligent for driving while "sleeping, tired and/or fatigued" and for driving at an "unsafe, excessive and dangerous" speed. Richard alleges Courtney was also driving while under the influence of alcohol, drugs or medication. 

Richard seeks compensation of more than $50,000, interest and all other proper relief. He is represented by Andrew Mundwiller of The Cagle Law Firm in St. Louis and Eric Carter, Sr., of The Law Firm of Eric M. Carter, Sr., LLC in LaPlace, La.
