Magazine subscriber sues publisher over misprinted edition

Lawsuits

EDWARDSVILLE — The publisher of Firearm News magazine is being sued by a subscriber after publishing half of the advertised material in a misprinted edition.

Ethan Borgemeyer filed a complaint March 17 in the Madison County Circuit Court against Outdoor Sportsman Group Inc., alleging violation of the Illinois Consumer Fraud and Deceptive Business Practices Act.

Borgemeyer alleges in his complaint that the defendants Firearm News publication, including its "18th Annual Treasury Edition," is advertised as being "packed with more than two-dozen articles on firearms and history during wartime." Borgemeyer claims that "due an apparent printing error," the publication released to subscribers was "exactly half" of what was advertised with half of the publication "missing" and the half that is printed, was printed twice. He also claims that Outdoor Sportsman engaged in a deceptive practice by selling subscriptions for $9.99 for an incomplete publication. Borgemeyer alleges that more than 10,000 copies of the "defective" publication have been purchased and acquired.

Borgemeyer seeks compensation of more than $50,000 and all other just relief. He is represented by Thomas Maag of The Maag Law Firm LLC in Wood River.
