EAST ST. LOUIS — A motorist and passenger allegedly injured in a Ferguson, Mo., crash are suing the at-fault driver and owners of the vehicle he was driving.
Megan Warner and Timothy Wheat filed a complaint March 17 in the U.S. District Court for the Southern District of Illinois against Luis Vargas also known as Luis Vargas Vazques, also known as Luis Vazques Vargas, Jose Lopez Cruz, also known as Jose Refugio Cruz, also known as Jose Cruz Zaragoza, also known as Zaragoza Jo Cruz, and Veronica Cruz, alleging negligence.
According to the plaintiffs' complaint, Megan Warner was driving her vehicle westbound on Robert Avenue near the intersection of Florissant Road in Ferguson, Mo., on Feb. 7 with Wheat as a passenger. She alleges Vargas, who was driving a pickup truck owned by the other defendants, "disregarded a traffic control device" and struck her vehicle.
The plaintiffs allege they suffered physical, emotional and economic injuries.
They claim Vargas was negligent in failing to stop or swerve to avoid the collision and was "traveling at a speed that was greater than reasonable and proper." They further claim Jose and Lopez Cruz knew or should have known that "it was unsafe to entrust" Vargas with their vehicle.
The plaintiffs seek compensation of more than $75,000 and all other just relief. They are represented by Jaye Lindsay of Crossroad Legal in O'Fallon.
