Medical practice sues health record software provider over alleged service issues

EWARDSVILLE —  A Maryville medical practice claims its health record system and practice management software provider's errors caused disruptions to its practice and insurance claims.   

Metro East Healthcare LTD filed a complaint March 1 in the Madison County Circuit Court against NextGen Healthcare Information Systems LLC ad TriZetto Provider Solutions LLC, formerly known as Gateway EDI LLC, alleging breach of contract, unjust enrichment, fraud and violation of the Illinois Consumer Fraud and Deceptive Business Practices Act. 

According to Metro East Healthcare's complaint, the company entered into a software license and services agreement with NextGen on June 29, 2012, for electronic health record and practice management software, including online data backups. Metro East Healthcare alleges the agreement also included using TriZetto  as a "medical clearing house" for the network system. Metro East Healthcare claims that throughout 2018, it experienced software issues. It alleges that for several months in 2019, TriZetto was unavailable to assist with the issues. The plaintiff further claims that it experienced "fundamental problems" that made the system inoperable, including issues with coding and insurance claim errors. Metro East alleges the issues "became so pervasive" that it was unable to carry out its day-to-day functions. NextGen allegedly promised compensation, which was never received. 

Metro East seeks monetary relief of more than $50,000 and all other proper relief. It is represented by Jonathan Dalton and Angela Kennedy of Armstrong Teasdale LLP in St. Louis.
