BELLEVILLE — An Illinois-based debt collection company is facing a class action, alleging it deceptively tried to collect time-barred debts.
Mackenzie Hise, formerly known as Mackenzie Brown, individually and on behalf of all others similarly situated, filed a complaint Feb. 16 in the St. Clair County Circuit Court against Enhanced Recovery Company LLC, alleging violation of the Fair Debt Collection Practices Act.
According to the complaint, Hise received a "dunning" letter from Enhanced Recovery on Jan. 13 alleging she had a $565.70 debt owed to Sprint. Hise alleges the letter stated it was from a "debt collector" and that she had not had an account with Sprint since moving to Illinois or made a payment to Sprint in the last nine years.
Hise claims that the letter failed to state the debt was "time-barred" from enforcement under the statue of limitation and that a suit could not be filed to enforce the debt. Hise further claims Enhanced Recovery's letter stated it was "authorized to settle" her account for $282.85, which would cease future collection efforts.
Hise seeks compensation of more than $50,000, plus attorney's fees and court costs. She also seeks class certification. She is represented by Christopher Roberts of Butsch Roberts & Associates LLC in Clayton, Mo.
