Skeeter's Pub sued after drunk driver allegedly caused collision

EDWARDSVILLE — A family who suffered injuries in a crash allegedly caused by a drunk driver is suing the intoxicated mototrist and the pub that served him alcohol.

Elizabeth Probasco, Vincent Probasco, Anna Probasco, a minor, by her parents and next friends, Elizabeth and Vincent Probasco, Caleb Probasco, a minor by his parents and next friends, Elizabeth and Vincent Probasco and others filed a complaint  Feb. 18 in the Madison County Circuit Court against Skeeter's Pub Inc., and Kyle Rothe.

The plaintiffs allege that on Feb. 20, 2020, Rothe had been drinking alcoholic beverages at Skeeter's Pub on Hackman Street in Staunton and became intoxicated. 

They allege Rothe then drove on Illinois Route 157 near Fruit Road in Madison County while intoxicated. He allegedly crossed over into the northbound lane of traffic and struck their vehicle. 

The plaintiffs claim the minor children, who were passengers in the vehicle, suffered injuries and have incurred medical expenses for their treatment. 

In their suit, the plaintiffs allege Skeeter's Pub was negligent for selling and serving Rothe the liquor, which led to his negligence of driving a motor vehicle while drunk. 

The plaintiffs seek compensation of more than $50,000 and all other proper relief. They are represented by Michael Hertz of Lucco, Brown, Dawson & Hertz LLP in Edwardsville.
