BELLEVILLE — A woman claims a substance on the floor of Sam's East in O'Fallon caused her fall and suffer injuries.
Karen Miller filed a complaint Feb. 5 in the St. Clair County Circuit Court against Sam's East Inc., and David Heaton, alleging negligence.
Heaton is the owner/operator of Sam's East, the suit states.
Miller claims in her suit that she was at Sam's East on West Highway 50 in O'Fallon on Aug. 8, 2020, when she slipped on "a foreign substance" that accumulated on the floor. As a result, Miller claims she suffered "severe" injuries including to her back, soft tissues, shoulder, muscles, ligaments, tendons and nerves.
Miller alleges Heaton was negligent for failing to manage, inspect and clean the premises. She alleges the defendants failed to have a "safe procedure" for cleaning substances and allowed its premises to "become and remain in a unsafe" condition. Miller also claims the defendants neglected to place "warning signs or cones" in the area of the alleged spill to warn customers.
