Demolition company sues over alleged failure to pay for asbestos removal at National Wildlife Refuge

BENTON — A St. Louis demolition company claims it was not paid for a project at the Crab National Wildlife Refuge. 

The United States, for use and benefit of Spirtas Worldwide LLC, filed a complaint Feb. 16 in the U.S. District Court for the Southern District of Illinois against SGLC Consulting LLC, Westchester Fire Insurance Company, Chubb Surety Claims and Grant Cunningham, alleging violation of the Miller Act, fraud and other claims. 

According to the complaint, SGLC entered into a trade partners agreement on Sept. 1, 2020, with the Department of Interior, U.S. Fish and Wildlife Service for the demolition and removal of asbestos from several buildings at the Crab National Wildlife Refuge in Marion. Westchester and Chubb provided bond for the project. The plaintiff alleges the contracted price for the project was $746,789.93. The plaintiff claims it provided materials and labor for the project. 

However, on Nov. 4, 2020, the plaintiff was allegedly ordered off the project by SGLC president and owner Cunningham "without any basis in fact" and was not paid for the work already performed. 

The plaintiff alleges Cunningham informed it that on Nov. 4 he had never signed the agreement and that he also attempted to hire their personnel, including their site supervisor to complete the project. 

The plaintiff seeks monetary and all other just relief. They are represented by J. Hatcher Graham of J. Hatcher Graham PC in Warner Robins, Georgia.
