Suit alleges drunk driver caused collision

EDWARDSVILLE — A motorist claims claims he was injured when he came upon a vehicle crash site caused by an alleged drunk driver.  

Roy McMullen filed a complaint Feb. 4 in the Madison County Circuit Court against Wyatt Criley, alleging negligence.

According to his complaint, McMullen was driving his vehicle northbound on Route 4 in Madison County on the morning of June 6, 2020. He alleges that he collided into Criley's vehicle and another vehicle that were in the middle of the road and obstructing the roadway. McMullen claims that prior to reaching the area where the collision occurred, Criley had been driving intoxicated. The suit states that Criley was attempting to make a left turn onto the Highway US-40 when he struck the front side of another vehicle. McMullen alleges that when he came upon Criley's crash with the other vehicle, he was rounding a curve and could not see any lights on the two vehicles blocking the roadway. Despite hitting the brakes, McMullen claims he could not avoid striking the two vehicles. 

McMullen claims he suffered injuries. He alleges Criley was not only negligent for driving under the influence, but also for failing to move his vehicle off the roadway and for being on the wrong side of the road. 

McMullen seeks compensation of more than $50,000 and all other just relief. He is represented by Gary Burger of Burger Law LLC in St. Louis.
