State Farm sues policy holder over payout from other driver's insurance

EDWARDSVILLE — State Farm is suing one of its policy holders who was involved in a collision, rejecting an arbitration decision and alleging she was not legally entitled to receive compensatory damages from another driver's insurance company. 

State Farm Mutual Automobile Insurance Company filed a complaint  Jan. 29 in the Madison County Circuit Court against Frances Jean Campbell.

According to the complaint, Campbell was involved in a vehicle crash on July 12, 2017, and filed a claim under her auto insurance policy held by State Farm. The policy includes bodily injury limits of $100,000 per person and $300,000 per collision. State Farm alleges that Campbell released all claims against the other driver involved in the collision and received a $25,000 payment from Geico General Insurance without State Farm agreeing to the amount of compensatory damages. 

State Farm also rejects a November 2, 2020, arbitration decision that found Campbell was entitled to $350,000 in compensatory damages. State Farm claims the decision is "non-binding" according to the terms of Campbell's policy. 

State Farm seeks monetary relief, trial by jury and all other just relief. It is represented by Martin Morrissey and Dominique Seymoure of Heyl, Royster, Voelker & Allen PC in Edwardsville.
