EDWARDSVILLE — A barge worker injured on the job in 2011 claims his former employer has failed to comply with a prior court ruling.
Richard Farley filed a complaint Feb. 1 in the Madison County Circuit Court against National Maintenance & Repair Inc., alleging violation of the Jones Act.
According to the complaint, Farley was injured on June 20, 2011, while working for National Maintenance Repair. He initiated a prior lawsuit in the Madison County Circuit Court to seek recovery under the Jones Act, unseaworthiness and for maintenance and cure.
He states in his complaint that the court found he was injured on June 20, 2011, while pulling a hose and that he "worked the majority of his time" on barges, which are considered vessels under the Jones Act. Farley alleges medical testimony showed he still requires treatment as well as potential surgery for his injuries.
A final judgement was made by the court on March 5, 2018, stating he has not reached "maximum cure." Farley claims National Maintenance has stopped paying him maintenance and has failed to respond to his requests for payment of on-going medical bills, despite the court's final ruling.
