Wrongful death suit alleges hospital, physicians failed to do proper cardiac testing

Lawsuits

EDWARDSVILLE — A man is suing Alton Memorial Hospital and several of its physicians for allegedly failing to do proper cardiac testing, resulting in a patient's death.

Brandon Hardimon, as special administrator of the Estate of Shirley Hardimon, deceased, filed a complaint Feb. 2 in the Madison County Circuit Court against Erik Daniels, M.D., Juletta Avagyan, M.D., Alton Memorial Hospital, Huzaifa Quaizar, M.D., and BJC Healthcare, alleging negligence.

The plaintiff alleges in his complaint that the defendants negligently cared for Shirley Hardimon on Feb. 11, 2019, at Alton Memorial Hospital, which allegedly resulted in her death on Feb. 19, 2011. Specifically, the plaintiff claims the defendants "negligently and carelessly" failed to perform "a complete cardiac work up" on Shirley Hardimon, who was suspected of having congestive heart failure caused by "underlying significant cardiovascular disease."

The plaintiff alleges the defendants did not "apply the knowledge and use the skill and care" that would be used by a "reasonably qualified" health care professional.  He also alleges that as a result of Shirley Hardimon's death, he has suffered "grief, sorrow and permanent injuries and damages."

The plaintiff seeks compensation of more than $50,000 and all other just relief. He is represented by Colleen Jones of Cook, Bartholomew, Shevlin, Cook & Jones LLP in Belleville.
