EDWARDSVILLE — A woman claims Walmart and a fencing company placed unsafe barriers on the sidewalk outside of a store in Wood River, causing her to trip and suffer injuries.
Helen Forgy-Sawyer filed a complaint Feb. 3 in the Madison County Circuit Court against Walmart Inc., Glenn Masterson and National Rent-A-Fence, alleging negligence.
The plaintiff claims in her suit that she was at the Walmart located on Wesley Drive in Wood River on May 28, 2020. She alleges that there was a "barrier with legs sticking upward" on the sidewalk which caused her to trip and fall. As a result, she claims she suffered injuries to her face, finger and side, including bruising and cuts.
Forgy-Sawyer alleges Walmart and general manager Masterson were negligent for failing to "properly inspect" the sidewalk in front of the store, failing to remedy the dangerous condition and failing to warn of the hazard.
She also alleges National Rent-A-Fence provided the "unsafe" barriers and are negligent in failing to inspect them and failing to repair or make sure they "were flush with the ground." The plaintiff further alleges that National Rent-A-Fence failed to direct Walmart employees to warn or remedy the dangerous condition.
The plaintiff seeks compensation of more than $50,000 and all other just relief. She is represented by Michael Glisson and Timothy Chartrand of Williamson, Webster, Falb & Glisson in Alton.
