EDWARDSVILLE — An Edwardsville nursing home is being sued after a man allegedly fell off a gurney while being transported into the facility and died as a result of his injuries.
Nancy Gabriel, administrator of the Estate of James Gabriel, filed a complaint Jan. 7 in the Madison County Circuit Court against Healthcare Accounting Services LLC, University Health Properties LLC and Edwardsville Health Care Center Investors LLC, alleging wrongful death.
The plaintiff's husband James Gabriel was being transported on a gurney by Alton Memorial Hospital ambulance staff to Healthcare Accounting Services property on Feb. 9, 2019, according to the complaint. The plaintiff alleges that while being transported, the gurney her husband was riding on became unstable and left the walkway causing him to fall to the ground. She claims her husband suffered a cervical fracture and "ultimately died from his injuries."
The plaintiff alleges the defendants negligently failed to maintain the sidewalk used to transport patients and failed to create "adjacent soil support" in order to prevent gurney wheels from tipping when it "left the paved surface."
The plaintiff seeks compensation of more than $50,000 and all other just relief. She is represented by Lanny Darr of The Darr Law Offices LTD in Alton.
