Customer sues Lowes over alleged slip, fall in parking lot

Lawsuits

EDWARDSVILLE — A customer claims he slipped and fell in a Lowes parking lot in Glen Carbon due to damaged concrete and improper snow and ice removal.

Ryan Suma filed a complaint Jan. 8 in the Madison County Circuit Court against Lowe's Home Centers LLC, also known as Lowe's, Lowe's Companies Inc., also known as Lowe's, Lowe's Home Centers Inc., Executive Lawn Care Services and Case Snow Management Inc., alleging negligence.

According to his complaint, Suma was at the Lowe's store on Whistle Stop Drive in Glen Carbon on Jan. 19, 2019. He alleges that while walking in the parking lot near the cart return, he slipped and tripped, causing him to fall.

Suma claims Lowe's and its third party agents, Executive Lawn Care and Case Snow Management, failed to keep cart corrals, drainage and gutters properly maintained and to properly salt and remove snow and ice from around the property.

He further claims Lowe's failed to repair broken, raised or sunken concrete on the property to keep it safe for guests and failed to warn of the hazardous condition which remained for "an unreasonably long period of time."

Suma alleges he suffered "diverse injuries both internally and externally" due to the defendants' negligence.

Suma seeks compensation of more than $50,000 and all other proper relief. He is represented by Jason Sherwood and Charles Zivin of The Sherwood Law Group LLC in Chicago.
