Woman alleges Bethalto property defects were not disclosed prior to purchase

EDWARDSVILLE — A woman is suing the previous resident of a property she purchased in Bethalto, claiming he failed to disclose several property defects. 

Kimberly Coleman filed a complaint Jan. 12 in the Madison County Circuit Court against Oliver Gibson, alleging violation of the Illinois Residential Real Property Disclosure Act.

Coleman alleges in her complaint that she purchased a property on Klein Drive in Bethalto in July 2020. The property was previously occupied by Gibson. Coleman claims Gibson failed to disclose "numerous material defects" required by the Residential Real Property Disclosure Act. 

She also alleges that per the Residential Real Property Disclosure Act, Gibson is liable for actual damages and court costs since he failed or refused to provide the required disclosure document prior to the sale of the property. 

Coleman seeks compensation of more than $50,000 and all other just relief. She is represented by Thomas Maag of The Maag Law Firm LLC in Wood River.
