Motorist alleges truck driver drove over mandated driving hours, caused vehicle crash

BELLEVILLE — A motorist claims a truck driver caused a rear-end collision after driving over the federally-mandated distance and time regulations. 

David Hoffman filed a complaint Dec. 23 in the St. Clair County Circuit Court against Boise Cascade Company, Boise Cascade Building Materials Distribution LLC and Timothy Ferrell, alleging negligence. 

Hoffman claims in his suit that he was driving his vehicle southbound on Illinois Route 203 in St. Clair County on Jan. 25, 2019. He alleges he was stopped at a red light at the intersection of Ohio Avenue when Ferrell, who was driving an open trailer owned by Boise, approached the intersection and struck the back of his vehicle. 

Hoffman alleges he suffered "severe" pain and discomfort due to "multiple injuries to his body" and has also incurred health care costs. 

Hoffman claims Boise "negligently and carelessly" permitted Ferrell to operate their vehicle and that he was driving a route in violation of the distances and time restrictions under federal regulations. He also claims Ferrell was driving at an excessive speed with his "ability or alertness" being impaired.   

Hoffman seeks monetary relief of more than $50,000, trial by jury and all other just relief. He is represented by Alan Pirtle and Eli Roberts of Brown & Crouppen PC in St. Louis.
