Illinois Central Bus facing class action over employee fingerprint scans

Lawsuits

BELLEVILLE — A class action lawsuit filed against Illinois Central Bus alleges the defendant illegally collected and stored employee's fingerprint scans.

Rebecca Luecking and Tracey Meyer, on behalf of themselves and other persons similarly situated, filed a complaint Dec. 29 in the St. Clair County Circuit Court against Illinois Central School Bus LLC, alleging violation of the Illinois Biometric Information Privacy Act (BIPA).

The class action alleges that within the past five years, the plaintiffs worked for Central School Bus and were required to scan their fingerprints in order to clock in and out of work at job sites. The plaintiffs allege their fingerprints were recorded, collected and stored in violation of BIPA. They claim they did not give consent for their biometric data to be collected and stored.

The plaintiffs allege they were not informed regarding the "specific purpose and length of term" their biometric information would be stored or given guidelines on how their information would be destroyed. They claim their data is also being stored "in a manner less secure" than other "similarly sensitive data."

The plaintiffs seek monetary and all other just relief. They are represented by Roberto Costales and William Beaumont of Beaumont Costales LLC in Chicago.
